Defendant was charged with Federal Illegal Re-entry, in violation of 8 U.S.C. Section 1326(a).

The Defendant was charged with Federal Illegal Re-entry, in violation of 8 U.S.C. Section 1326(a). The Defendant had been convicted of Possession with Intent to Distribute out of Florida, and had served 55 months incarceration. After his release, he was placed on Supervised Release for a period of 3 years. Although the Defendant was facing a period of 84 months incarceration, we were able to obtain a much more favorable outcome at sentencing: 23 months incarceration.

A 20 year old Defendant was charged with both Evading Arrest in a Motor Vehicle and Resisting Arrest.

A 20 year old Defendant was charged with both Evading Arrest in a Motor Vehicle and Resisting Arrest. Both cases were ultimately dismissed in favor of the Defendant.

A 27 year old Defendant was charged with Possession of Marijuana.

A 27 year old Defendant was charged with Possession of Marijuana. Mr. de la Garza successfully argued that the Marijuana was obtained in violation of the 4th Amendment. Specifically, that the Marijuana was obtained as a result of an illegal inventory search. The case was dismissed against the Defendant.

Slip and Fall Accident - Substantial Settlement

A 55 year old woman entered a local supermarket in San Juan, Texas and slipped and fell as a result of a water spill that had gone unnoticed by management. The Plaintiff suffered minor injuries to her lower back. The Defendant awarded the Plaintiff a substantial settlement for injuries and damages sustained.

Alleged debt negotiated down from $120,000 to $60,000.

A Plaintiff produce company filed suit against Defendant produce company as a result of an alleged debt. The Plaintiff produce company obtained a pre-judgment writ of garnishment freezing the Defendant produce companies bank account funds. A hearing to dissolve the garnishment was immediately held. Shortly thereafter, the Defendant Produce company's bank account was unfrozen - and the alleged debt was negotiated down from $120,000.00 to $60,000.00.

Undocumented 19 year old was arrested for Unlawful Possession of Weapon.

Undocumented 19 year old was arrested for Unlawful Possession of Weapon. The Defendant had been living in the U.S. since the age of 5. After posting the criminal bond, the Defendant was released to custody of ICE. ICE denied Defendant / Respondent an immigration bond in spite of numerous requests. The Immigration Judge also denied the Defendant / Respondent a bond as a result of the pending Unlawful Possession of Weapon charge. However, soon thereafter Mr. de la Garza successfully obtained a dismissal on the pending criminal charge. As a result, a subsequent Application for Bond was filed before the Immigration Judge. Although hesitant, the Immigration Judge set an immigration bond based on "changed circumstances," and the Defendant / Respondent is now awaiting a decision on his Deferred Action application with USCIS.

Undocumented 22 year old was arrested for Furnishing Alcohol to a Minor.

Undocumented 22 year old was arrested for Furnishing Alcohol to a Minor. As a result, ICE placed a hold on Defendant. Nevertheless, ICE proceeded to remove the ICE hold almost immediately after Mr. de la Garza successfully presented ICE with all of the positive equities of his client. Shortly thereafter, the client was released into the public. That is, EOIR never initiated removal proceedings agains the client. Some time later, the client's criminal case was dismissed.

Undocumented 27 year old female was arrested for Driving While Intoxicated

Undocumented 27 year old female was arrested for Driving While Intoxicated with a Minor Child, a State Jail Felony. As a result, an ICE hold was placed on the Defendant. Mr. de la Garza was successful in obtaining her release from ICE the same day that ICE took her into custody. Her immigration case was later set for hearing and the client is now in the process of obtaining legal permanent residency
