Family Members of U.S. Citizens

Naturalization and Citizenship Issues

Becoming a U.S. citizen is an important and meaningful event for many immigrants. Many factors need to be considered before applying for naturalization. Keep in mind that past immigration and criminal activity can have an effect on your naturalization application. Our office handles initial naturalization applications as well as appeals from naturalization decisions.

In order to qualify for Naturalization:

  • You must be 18 yrs. Or older
  • You must have lived in the United States for five years (three years if married to a U. S. citizen)
  • You must physically live in the United States from the date of application to the time of naturalization
  • You must read, write, and speak English and know U.S. history and government
  • You must be a person of good moral character
  • You must pledge to the U.S. constitution and renounce all foreign allegiance

Citizenship Issues and Federal Immigration Matters
U.S. immigration law provides for acquisition of citizenship for individuals born abroad who claim U.S. citizenship through a U.S. citizen parent. The law that was in effect at the time of the claimant’s birth determines the requirements needed to acquire citizenship.

Unknowingly, some individuals automatically derive citizenship as a result of their parents’ status at the time of their birth. Other individuals U.S. citizen status comes into question because of duplicate birth certificates or q questionable midwife birth. Federal action is commonly required to resolve citizenship claims and to prevent the government from denying immigration benefits to family members that would otherwise be eligible.
